The real estate in Vietnam is more, than simply real estate. It is lifestyle, it is the Asian song, it is unique heart beat of the jungle, these are wild beaches, fantastic islands, it is roughly developing Asian capitalism, it is improbable profit for those who will appear here in necessary hour. And hour punched!

It is known that to the foreign companies until recently didn't allow to acquire real estate in Vietnam. Earth, under SRV Constitution, can't be a private property at all. Nevertheless, the earth is provided under the Contract of long-term rent (for 50-70 years) with the subsequent prolongation. Thus, Vietnamese say that actually it not rent, and acquisition. Earth or the objects received by the investor in long-term using, can be sold, presented, transferred to inheritance, to management, are put. Receiving such rights completely coincides with definition of the private property given still by K.Marx.

This year big inflow of the capital to the Vietnamese real estate - about 20 billion dollars is expected. The reasons of such activization it appeared a little. Establishment of constant trade relations between the USA and Vietnam, introduction in the country of the law on investments and the entry of Vietnam into the WTO was opened to foreign investors by direct access to the financial markets of Vietnam and possibility of participation in the projects connected with real estate.

Even concerning foreign individuals Vietnam took this year a step towards.

On May 22 at session of National assembly of Vietnam the resolution allowing foreign citizens to get in property (literally - to buy and own) rooms of public (house) in the sphere of commercial real estate is accepted. The resolution comes into force since January 1, 2009 and extends on the following types of categories of citizens:

private investors in Vietnam or the persons working at leading positions in all operating enterprises in Vietnam, including in Representations of the foreign companies in SRV;

the persons awarded by medals, awards SRV, or the persons having special merits in front of Vietnam;

the persons working in all significant social and economic spheres of Vietnam;

the persons who were getting married with citizens of SRV;

to employees to whom the enterprise with the foreign capital at which a primary activity isn't the sphere of real estate got apartments and where acquisition of apartments is carried out for accommodation of their foreign personnel.

Possession term - is defined no more than 50 years. Within a year after end of term of possession, individuals can sell or present the apartments, they can leave also them in inheritance or pawn to the credit organizations operating in Vietnam.

We surely look into the future of projects on real estate in Vietnam because we can already resolve such issues now, finding legal openings in the existing legislation of SRV, providing profitability according to transactions of foreign investors, insuring all risks and bending around possible reefs.
